iv. When Dealer is Consumer:

It is the responsibility of the information provider to verify the authenticity of the data and promptly address any inaccuracies or discrepancies while complying with the applicable data protection laws and regulations.
iii. Accessing our services from Outside of North America: If you are accessing our website, Aryo Cloud platform, and App from outside of the United States (US) or Canada, it's important to be aware that data will be transferred to Epic's servers located in Canada. By using our services, you consent to this data transfer and acknowledge that your personal information will be subject to applicable laws and regulations regarding data protection and privacy.
c. Data Breach Notification
In the event of a data breach that compromises the security of your data and your customer’s within our services, Epic will follow the specific country’s privacy laws, and attempt to minimize the data breach by following the steps below.
- Epic makes its best effort to notify every applicable user at the first reasonable opportunity that there has been a breach of data.
- CMS and Dealers are responsible for notifying their customers at the first reasonable opportunity if their data is stolen, lost, or accessed by unauthorized persons.
- Epic may provide assistance to CMS and Dealers to enable them to identify, contact, and inform users affected by the breach. Users might receive information about the circumstances of the breach, what information was used or disclosed, measures taken to mitigate any harm resulting from the breach, and advice on measures they can take to further mitigate any potential harm.
4) Data Sharing
a.Authorized CMS
Epic may share your data with the authorized CMS who have been granted access to the Aryo Cloud platform and App. This sharing of data is essential for the CMS to fulfill its responsibilities in providing monitoring services to you.
b. With Your Consent or Anonymized Data
Epic may share your data with third parties if you have provided your explicit consent for such sharing. Additionally, Epic may share anonymized and aggregated data that does not personally identify you, for research, analytics, or industry benchmarking purposes.
c. In Case of Company Merge
In the event of a merger, acquisition, or sale of assets involving Epic, your data may be transferred to the acquiring or merged entity as part of the transaction. Epic will ensure that any such transfer is conducted in compliance with applicable data protection laws and regulations.
d. Legal Compliance & Protection
Epic may disclose your data if required to do so by law or in response to valid legal requests, such as subpoenas or court orders. Furthermore, Epic may disclose your data to protect the rights, property, or safety of Epic, its users, or others, when necessary to enforce the Terms and Conditions of your agreement with Epic or to respond to claims of any violation.
